Released on undertaking

When a person is arrested or charged with an offence, they may be released from Police custody on undertaking. An undertaking is a signed promise to attend court on a given date and time and with certain conditions attached. Conditions may include not committing any further offences and not approaching any victims and witnesses. A breach of undertaking conditions is an offence and can lead to prosecution.

At this stage in the justice system, there may be an opportunity to support an individual to tackle the underlying causes of crime and improve future outcomes.

There are organisations across Scotland that deliver a wide range of support relating to community justice.
