Diversion from Prosecution
A Procurator Fiscal may decide to refer a case to Criminal Justice Social Work in instances where this referral may prevent further offending. In these cases, prosecution may be waived or deferred pending the successful completion of this diversion.
The most recent data shows that in 2023/24 there were 3,354 diversion from prosecution cases that commenced in Scotland. This related to 3,098 individuals.

At this stage in the justice system, there may be an opportunity to support an individual to tackle the underlying causes of crime and improve future outcomes.
